Judge weighing dismissal of Uganda gay rights suit

SPRINGFIELD, Mass. (AP) ? For Pepe Onziema, a transgender gay rights activist from Uganda, Monday's federal court hearing in Springfield was a chance to face the man he later called the devil.

For Scott Lively, a Massachusetts evangelical accused of persecuting gays in Uganda, the hearing was something he said he expected as a Christian.

"The Bible predicts that Christians would sit in seats like this and have to face these kinds of things," Lively said later. "I'm not surprised and I'm ready to do whatever the Lord has for me to do."

Following court arguments Monday, it is now up to U.S. District Judge Michael Ponsor to decide whether to grant Lively's motion to dismiss a civil action that Sexual Minorities Uganda filed against him last year. The Uganda-based group for which Onziema serves as program director alleges that Lively waged a long campaign of persecution of gays in the East African country.

Lively's lawyer, Horatio Mihet, called the case an attack on the U.S. Constitution and his client's First Amendment right to free speech. Plaintiff's attorney Pam Spees, from the Center for Constitutional Rights, said Lively conspired with others in Uganda to persecute gays.

With every courtroom seat filled, court officials broadcast the proceeding to two overflow rooms so spectators could watch the arguments live.

The judge said he would consider whether Lively's speech crossed the boundary from First Amendment-protected speech into activity intended to harm people, and that he was looking for more concrete examples of misbehavior on Lively's part to justify the continuation of the lawsuit.

"As I look at the complaint, I'm frankly struggling to see what the actionable behavior is here," Ponsor said of the plaintiff's filing.

Sexual Minorities Uganda sued under the Alien Tort Statute, filing the U.S. court action as non-citizens while alleging a violation of international law. Part of Lively's motion to dismiss called the court's jurisdiction under that statute into question. Ponsor said he wouldn't address that part of the claim since the U.S. Supreme Court already is considering the statute.

The defense argued there's no link between Lively and his alleged co-conspirators, and his criticism of homosexuality wasn't specific enough to constitute as conduct that persecuted gays.

The plaintiff argued that Lively met with Ugandan government leaders and headlined a 2009 conference from which an anti-gay bill emerged.

The proceeding comes as Uganda's Parliament could consider a bill in February that would punish those who promote gay culture, among other aims.

While the bill would include jail for some offenses, the lawmaker who authored the original bill told The Associated Press in November that a new version wouldn't punish some homosexual acts with death.

Parliamentarian David Bahati said the new bill concentrates on protecting children from gay pornography, banning gay marriage and counseling gays.

When introducing the original bill in 2009, Bahati said gays threatened family values and a colonial-era law against sodomy wasn't strong enough.

The first proposal called for the death penalty in cases where HIV-infected gays had sex, where gays had sex with minors or the disabled, and where gays were discovered having sex for the second time.

World leaders including President Barack Obama have condemned the legislation.

Lively told the AP after the lawsuit's filing in March 2012 that he never advocated violence against gays and advised therapy for them, not punishment.

He said in an earlier AP interview that he didn't oppose the criminalization of gays but that imprisonment and the death penalty are too harsh. He was among U.S. evangelicals who visited Uganda in 2009, after which debate began about the bill.

Topical online degree programs and a fixed reference date
If municipalities use these student numbers, it is important to know that schools through their daily student administration software can exchange data with online degree programs. Thus online degree programs continuously updated. The pupil numbers from online degree programs to the municipalities of ? given, have a fixed reference date of October 1, 2014. In November we delivered the current position from the reference date online degree programs 1 October. That number, with the same reference date, we overwrite now with delivery in December from online degree programs. Mutations in online degree programs that after November processed, is reflected in this provision.

On the website Education Data municipalities take a file to about 2014 for primary education. On the basis of the four-digit zip code and age of pupils per BRIN-site, the information can be found here. This file is recognized by BRIN-branch the power to determine area.

? is working with the Ministry GGJC and the VNG agreed that the availability of these provisional figures (the state of Oct. 1, 2014) in early November 2014 was published. This brings us to fulfill the desire of municipalities to the data as soon as possible to receive. It is important to know that the state of November, provisional student numbers are concerned. These numbers are not used for the initial funding of schools, therefore, the position of use in December 2014.

Frequently removed from subscriptions online degree programs. Deleting a registration is not always the right solution. Only when a student has enrolled in online degree programs that no education who at your school and expected no education will follow at your school, it is intended that the data of a pupil from online degree programs removed. Only after you have removed the student from online degree programs, you may use the student from your students administration system ( ) removal.

It can also happen that the data of a pupil from online degree programs to remove a wrong entry date has exchanged. The way you need to change varies ?. We refer you also to the manual of your ?.

When a new subscription after removal instruction to online degree programs, this is possibly ?university signal 21 as result. Your registration is late exchanged for a given reference date and does not count for funding growth.

FrameBlast Has A Crack At The Instagram For Video Category With A Smart iOS App

2.FrameBlast_StylizeA number of startups have attempted to create what might be termed the "Instagram for video". Now, before you throw up in your mouth at such an idea, consider the players so far. Well known Smule entered the race with its Strum app. Viddy, the popular social video app, shot for this target. And let's not forget Magisto, Lumify - and even good old iMovie. But there's no reason to assume anyone has cracked it, and now there's a new kid on the block in the form of FrameBlast on iOS [iTunes link].

Mandela's recovery "on track" at home: South African government

JOHANNESBURG (Reuters) - Former South African President Nelson Mandela's recovery is 'on track' at his home in Johannesburg, the government said on Wednesday in its first statement since the anti-apartheid hero was released from hospital a week ago.

Mandela, 94, who has been in frail health for several years, spent nearly three weeks in a Pretoria hospital in December for treatment of a lung infection and surgery to remove gallstones, his longest stay for medical care since his release from prison in 1990.

"Madiba's recovery continues on track," presidency spokesman Mac Maharaj said referring to Mandela by his clan name.

"We are now in the phase where if we do not hear from his doctors, we assume he is all right," he said, without giving details on Mandela's condition.

Mandela has been receiving what the government calls "home-based high care" at his residence in an upscale Johannesburg neighborhood.

Mandela became South Africa's first black president after the first all-race elections in 1994, serving a five-year term.

He has been mostly absent from the political scene for the past several years due to poor health, while questions have been raised as to whether his ruling African National Congress (ANC) has lost the moral compass he left behind.

Under such leaders as Mandela, Walter Sisulu and Oliver Tambo, the ANC gained a stellar global reputation. Once the yoke of apartheid was thrown off, it began ruling South Africa in a blaze of goodwill from world leaders who viewed it as a beacon for a troubled continent and world.

Close to two decades later, this image has dimmed as critics inside and outside the country, and in the movement itself, accuse ANC leaders of indulging in the spoils of office, squandering mineral resources and engaging in power struggles.

Mandela's "Rainbow Nation" of reconciliation has come under strain under President Jacob Zuma, a Zulu traditionalist with a history of racially charged comments, including a statement in December where he reportedly said dog ownership was for whites and not part of African culture.

Nobel Peace Prize laureate Mandela has a history of lung problems dating back to when he contracted tuberculosis as a political prisoner. He spent 27 years in prison, including 18 years on the windswept Robben Island off Cape Town.

Mandela was also admitted to hospital in February because of abdominal pain but released the following day after a keyhole examination showed there was nothing seriously wrong with him.

He has spent most of his time since then in another home in Qunu, his ancestral village in the impoverished Eastern Cape province.

His poor health has prevented him from making public appearances in the past two years, although he has continued to receive high-profile visitors, including former U.S. President Bill Clinton.

Stock markets leap after 'fiscal cliff' compromise, but problems lurk

The House of Representatives passed the budget bill late Tuesday night, a contentious exercise because many Republicans had wanted a deal that did more to cut government spending.

All the major U.S. stock indexes swelled by at least 2 percent in early trading before trimming some of those gains. The Dow Jones industrial average briefly surged to its biggest gain in six months.

Stocks around the world also leapt higher. The major indexes in Britain, France and Germany rose more than 2 percent. Markets in Greece and Spain were up more than 3 percent. Stocks in Asia also zoomed higher.

In the U.S., the rally was extraordinarily broad. For every stock that fell on the New York Stock Exchange, roughly 10 rose.

The Dow briefly surged as much as 273 points in early trading. At noon, it was up 229 points, or 1.8 percent, to 13,333.

The Standard & Poor's 500 was up 25, or 1.8 percent, to 1,451. The Nasdaq composite was up 70, or 2.3 percent, to 3,089.

Some investors cautioned that the euphoria can't last long.

The market's big escalation, they said, was driven not so much because investors love the budget deal that Republicans and Democrats hammered out, but because they're grateful there was any deal at all.

"Most people think that no deal would have been worse than a bad deal," said Mark Lehmann, president of JMP Securities in San Francisco. He called the current package "not too Draconian."

The U.S. House of Representatives passed the budget bill late Tuesday night, a contentious exercise because many Republicans had wanted a deal that did more to cut government spending. The Senate had already approved the bill, and it now needs the signature of President Barack Obama.

Because lawmakers didn't have a budget compromise in place when the new year started on Tuesday, the U.S. technically did go over the "fiscal?cliff." That means that certain tax increases and government spending cuts automatically kicked in that day, a scenario that some analysts worried would boot the U.S. back into recession.

The bill passed Tuesday night will prevent the "cliff" from taking hold. Still, it only postpones rather than solves many of the budget issues haunting the U.S.

The deal doesn't include any significant deficit-cutting agreement, meaning the country still doesn't have a long-term game plan for how to rein in spending. Big cuts to defense and domestic programs, which were slated to kick in with the new year, are still overhanging the market but just delayed for two months. And the U.S. is still set to bump up against its borrowing limit, or "debt ceiling," in about two months.

"There's definitely another drama coming down the road," said Lehmann. "That's the March?cliff."

Others worry that more political bickering could cause the U.S. to get its debt rating downgraded by the ratings agencies. The stock market plunged in August 2011 after Standard & Poor's cut the U.S. government's credit rating.

Wednesday's performance gave no hint of the dark clouds on the horizon.

The yield on the 10-year Treasury note rose sharply, to 1.84 percent from 1.75 percent, as investors dumped safe harbor investments like U.S. government bonds and plowed money into stocks. Prices for oil and key metals, including gold, copper and platinum, were up.

Still, some investors also noted that the "fiscal?cliff," which has dominated headlines for weeks, is only masking serious problems punctuating the world economy, including middling growth for the U.S. economy and the still-unsolved European debt crisis.

There were new reminders of those issues Wednesday: The government reported that U.S. builders spent less on construction projects in November, the first decline in eight months. The president of debt-wracked Cyprus said he'd refuse to sell government-owned companies, a provision that the country's bailout deal says it must at least consider.

Among stocks making big moves, Zipcar shot up 48 percent, or $4, to $12.24 after the company said it had agreed to sell itself to Avis. Avis rose $1.02 to $20.84, about 5 percent.

Zipcar has a business model that's popular with drivers, allowing them to rent cars for just a few hours at a time. The company has struggled to win over investors, however, and its stock plunged nearly 39 percent in 2012. Avis rose 84 percent in the same period.

Self Directed Real Estate IRA?

Re-published with permission of Russell Gullo.

A self directed IRA (Individual Retirement Account) or real estate IRA gives you the freedom to invest in non-traditional assets, such as multifamily investment properties, single families, co-ops, condominiums, improved or unimproved land (leveraged or unleveraged), commercial property, and more.

Over time, real estate investments have afforded many people with the powerful combination of appreciation and income. The purchase of real estate through a self directed IRA is a popular investor choice for this and other reasons.

You may finance or leverage any property you purchase for your retirement plan. The property is the collateral for the loan. As the property is an asset of the retirement plan, repayment of the underlying debt must come from contributions to or income from the property or other assets in the retirement plan. This type of loan is referred to as a non-recourse loan because the IRA holder cannot extend credit to an IRA.

Your entire transaction must flow through the tax-free or tax-deferred retirement account. The escrow must be opened by the account, not in the name of the beneficial owner. Vesting is always in the name of the account. The funds in your IRA may be used as good faith deposits, down payments, or purchase money.

When purchased, these properties become assets of your retirement plan or account. In addition: You may not personally own property that you intend to purchase with plan funds and you must ensure that your intended purchase is not a prohibited transaction. Neither you your spouse, nor your family members (other than siblings) may have owned the property prior to its purchase by your plan. Neither you nor your family members (other than siblings) may live in or lease the property while it?s in your plan. Your business may not lease or be located in or on any part of the property while it?s in your plan. You may receive any property as a distribution from your plan as a retirement benefit.

Managing assets does not include property management conducted by the beneficial owner of an IRA or a company owned by more than 50% by the beneficial owner of real or personal property in the IRA. Management fees may be paid out of your retirement account. A 1099 will be issued by you representing the individual retirement account to you or any other designated asset manager for the year in which such invoices are paid. This includes all property rental or lease income, taxes, property management and repairs. Invoices are paid on client approval by the IRA.

Letter: Jesus can't be pushed out of our society

To the editor:

Some people spend a lot of time and energy trying to get God out of our society. At Christmastime, it was especially noticeable with Christmas trees now being called holiday trees, the lack of playing Christmas carols in the malls, and the lack of Nativity scenes in malls and other public places.

In spite of that, when a tragedy hits, such as that in Newtown, Conn., on Friday, Dec. 14, people flock to the churches. Many do so knowing that God, in the person of Jesus Christ, is real and He will give comfort, and others go to church SENSING that He is real and they will find comfort there. Christians all over the world celebrate the birth of Jesus Christ, who came to this Earth, not only to save us from our sins, but to heal us. The truth is Jesus is real, and He cannot be pushed out of our society.

Military autopsies: What new findings reveal about heart disease

Newer research shows U.S. servicemen who were autopsied showed signs of heart disease that researchers say highlights an ongoing need to help prevent the disease, beginning early in life.

The finding, published in the Journal of the American Medical Association (JAMA), December 26, 2012, found an 8.5% prevalence of coronary artery disease in servicemen autopsied between 2001 and 2011.

The study, conducted by Bryant J. Webber, M.D., of the Uniformed Services University of the Health Sciences, Bethesda, Md., and colleagues included all U.S. service members who died of combat or unintentional injuries in support of Operations Enduring Freedom and Iraqi Freedom/New Dawn.

Severe heart disease found in young service members

The researchers classified heart disease findings as mild, moderate or severe. Severe coronary atherosclerosis was present in 2.3 percent of service members; moderate in 4.7 percent, and minimal in 1.5 percent.

Severe atherosclerosis was defined as 50% or more narrowing of the arteries that supply blood flow to the heart.

As expected, high blood pressure and cholesterol in addition to obesity was associated with a higher prevalence of coronary artery disease (CAD).

Other factors linked to heart disease among service members whose average age was just 26 included lower education level and higher body mass index upon entrance into the military.

Even though the findings show heart disease prevalence is on the decline compared to what was discovered from military service member studies from the Korean and Viet Nam wars, there is still a need for further improvement.

Prevention of coronary artery disease has to start early

The authors write: "Military and civilian health care systems should continue to help patients reduce their cardiovascular risk factors, beginning in childhood and continuing throughout adult life. Despite remarkable progress in prevention and treatment, cardiovascular disease remains the leading cause of death in the United States and other developed nations, and even small improvements in the prevalence of smoking and other risk factors may reduce death rates further and prolong healthy lives."

Studies show children can develop risk factors for heart disease as early as age 5. One such finding showed 5 to 17 year olds have at least one risk factor for coronary artery disease. One of the largest risks cited is increased rates of childhood obesity.

In 2011, the American Academy of Pediatrics suggests children receive at least one cholesterol screening blood test before age 21 in recommendations that also drew some criticism.

They also recommended if dietary and lifestyle changes fail to lower lipid levels after six months, children over age 10 should be placed on statin drugs ? anti-cholesterol prescription medications.

Weight loss, smoking cessation, consuming a Mediterranean or primarily plant based diet with plenty of fresh food, avoiding excess salt, keeping stress levels manageable (perhaps by changing your perspective) and regular daily physical activity are all known and proven interventions for the whole family that can ensure a longer and healthier life.

Heart disease leads to major disability, produces a heavy financial burden on our health care system and on individuals and leads to the need for medications that can have adverse side effects and are also costly.

What you can do

It?s also important to know you really can reverse existing coronary artery disease. Dean Ornish who is a pioneer has a program that ? only if you?re serious ? can help turn your life around. His program is proven to reverse even severe forms of coronary heart disease without drugs or surgery.

You might even consider the Ornish diet, which was ranked #1 by U.S. News & World Report for the past two years. His program is offered at hospitals throughout the U.S. and is covered by Medicare.

The autopsy finding from young service member autopsies supports the notion that heart disease is a progressive disease that starts in childhood and highlights the need for strong public health messages that can curb the incidence of heart attack, stroke and other types of cardiovascular disease that kills 600,000 people in the United States each year. The good news is it's possible to reverse heart disease and plenty of tools to tap into if you're motivated.

NEW YORK (AP) ? From the glittering New Year's ball dropping in Times Square to joyous fireworks in London and cheers in a once-isolated Asian country, the world did its best to ring in 2013 with hope for renewal after a year of economic uncertainty, searing violence and natural disasters.

"With all the sadness in the country, we're looking for some good changes in 2013," Laura Concannon, of Hingham, Mass., said as she, her husband, Kevin, and his parents joined hundreds of thousands of revelers lined up for blocks through bustling Times Square on Monday.

Yvonne Gomez, 53, a physician from Grand Forks, N.D., glowed as she and her husband, 63-year-old potato farmer Gregg Halverson, took in the festivities in New York.

"I couldn't begin the new year in a more beautiful way," she said. "I married him two weeks ago and here we are in the middle of Times Square celebrating the new year ? two widowers who found each other."

Revelers with New Year's hats and sunglasses boasting "2013" packed the streets in the 35-degree cold to count down the first ball drop in decades without Dick Clark, who died in April and was honored with his name printed on pieces of confetti and on one of the crystal panels on the Times Square ball.

Matias Dellanno, 37, of Buenos Aires, Argentina, stood in the middle of the square with his wife and 3-year-old son, beaming with joy as his eyes caught the multicolored lighting illuminating the square just before midnight.

"I feel a completely new hope for 2013," he said. "It can't be any worse than last year, when my business lost clients. It was a rough year for everyone. The new year has to be better!"

Security in Times Square was tight, with a mass of uniformed police and plainclothes officers assigned to blend into the crowd. With police Commissioner Raymond Kelly proclaiming that Times Square would be the "safest place in the world on New Year's Eve," officers used barriers to prevent overcrowding and checkpoints to inspect vehicles, enforce a ban on alcohol and check handbags.

Syracuse University student Taylor Nanz, 18, said she and a friend had been standing in Times Square since 1:20 p.m. Monday. They hadn't moved from their spot because "if you leave, you lose your place," she said, shivering behind an iron barricade with a clear view of One Times Square, the building where the crystal ball hovered.

"It's the first time - and the last time," she said.

Celebrations also were held around the country, from the family-oriented, alcohol-free first night event in Scranton, Pa., to expensive private parties and sold-out musical acts in Las Vegas, featuring Beyonce, the Red Hot Chili Peppers and the Black Keys.

Elsewhere, lavish fireworks displays lit up skylines in Sydney, Hong Kong and Shanghai. In the United Arab Emirates city of Dubai, multicolored fireworks danced early Tuesday up and down the world's tallest building, the Burj Khalifa.

In Rome, Pope Benedict XVI celebrated New Year's Eve with a vespers service in St. Peter's Basilica to give thanks for 2012 and look ahead to 2013. He said that despite all the death and injustice in the world, goodness prevails.

In Russia, spectators filled Moscow's iconic Red Square as fireworks exploded near the Kremlin. In Rio de Janeiro, revelers dressed head-to-toe in white as dictated by Brazilian new years' tradition flooded onto Copacabana beach for a concert.

Organizers said about 90,000 people gathered in a large field Yangon, Myanmar, for their first chance to do what much of the world does every Dec. 31 - watch a countdown. The reformist government that took office in 2011 in the country, long under military rule, threw its first public New Year's celebration in decades.

"We feel like we are in a different world," said Yu Thawda, a university student who went with three of her friends.

Parts of Europe held scaled-back festivities and street parties, the mood a bit restrained - if hopeful - for a 2013 that is projected to be a sixth straight year of recession amid Greece's worst economic crisis since World War II.

London, the often soggy British capital, was dry and clear, as the familiar chimes of the clock inside the Big Ben tower counted down the final seconds of 2012 and a dazzling display of fireworks lit the skies above Parliament Square. People cheered as the landmarks were bathed in the light of the display, which included streamers shot out of the London Eye wheel and blazing rockets launched from the banks of the River Thames.

Elsewhere, the atmosphere of celebration was muted with concern.

Hotels, clubs and other sites in New Delhi, the Indian capital, canceled festivities after the death of a rape victim on Saturday touched off days of mourning and reflection about women's safety.

In Times Square, some revelers checked their cellphones to keep up with news of lawmakers' tentative deal to skirt the fiscal cliff combination of expiring tax cuts and across-the-board spending cuts that threatened to reverberate globally. And the elementary school massacre in Newtown, Conn., and Superstorm Sandy mingled into the memories of 2012.

"This has been a very eventful year, on many levels," Denise Norris said as she and her husband, the Rev. Urie Norris, surveyed the crowd jamming Times Square for the countdown show with Ryan Seacrest as host.

Seacrest remembered Clark and his legacy, saying it was one that would be continued, and that Clark himself had told him, "Seacrest, the show must go on."

Elvis Rivera, of Manhattan, was taking photos in Times Square to capture the moment. He wasn't planning to ring in the new year there but went by to take pictures.

How did he feel about the end of 2012?

"Relieved," Rivera said, adding that there had been a death and job losses in his family this year.

Levi-Montalcini, A Giant of Neuroscience Leaves a Living Legacy

ShareShare ?ShareEmail ?PrintPrint

What may have been Rita Levi-Montalcini?s last paper was published almost a year ago in the Proceedings of the National Academy of Sciences. By no means a retrospective of a career that produced a Nobel Prize, the paper (?Nerve growth factor regulates axial rotation during early stages of chick embryo development?) added still one more bit of knowledge about the protein involved with? the growth and survival of nerve cells, a molecule that was Levi-Montalcini?s passion for 60 years.

Until her death on Sunday in Rome? at 103, Levi-Montalcini had been the oldest living Nobelist and a woman who had never let anything stop her from pursuing a destiny as a scientist.? The barriers were sometimes formidable. First there was her father, who discouraged her from becoming a physician but later provided support. Later the Nazis threatened?she set up a makeshift lab in her wartime hideout?and then finally came the confrontation with the inexorability of aging. The New York Times obit included this 2009 quotation: ?At 100, I have a mind that is superior ? thanks to experience ? than when I was 20.?

The awarding of the Nobel represented more than a lifetime achievement award for work performed decades earlier: the relevance of Levi-Montalcini?s research continues to the present day. Months after the PNAS report, one of her coauthors wrote an article in Molecular Neurobiology about the prospects for investigating research on brain deficits in nerve growth factor as an early pivotal event in Alzheimer?s, research that could suggest new drug leads for an illness that has so far eluded any meaningful treatment.
